The client was a bakery clerk who slipped and fell on a banana peel in a supermarket where she worked. Due to a variety of negligent acts by the treating doctors and hospital (including misreading the CT scan and failing to properly monitor her medications), this client will spend the rest of her life in a wheelchair.

After securing a liability judgment, obtained a $4,000,000 recovery during the damages trial for a 31-year-old Suffolk roofing foreman who fell through a ventilation hole in a roof at a Manhattan construction site. The hole had been camouflaged by a thin piece of wood and hence was not seen by the client. The client sustained many fractured bones and urological injuries after he landed on a construction shanty 40 feet below.

Obtained a $3,000,000 settlement for a 39-year-old laborer injured while working during the construction of a new school in Queens. The client fell 14 feet off a ladder landing on his back, sustaining serious personal injuries and requiring several surgeries. Defendant unsuccessfully argued that my client was a “recalcitrant worker” to evade liability; that argument was successfully defeated, and within days before trial, the case settled providing lifetime payouts to my client.

$2,600,000 settlement for roofing foreman injured at construction site

Obtained a $2,600,000 recovery for a 49-year-old roofing foreman who fell 20 feet through an unprotected hole in a roof, landing on a carpet rack in the store below which he straddled. The client sustained serious urological injuries necessitating a penile prosthesis. After securing a liability judgment, the defendants settled instead of continuing to contest the damages.

Obtained a $1,400,000 settlement after securing a liability judgment for a 38-year-old taper working at a Brooklyn construction site. He fell through a hole in a poorly lit area, which had no warnings or protective barricade. The client fell two stories, landing onto a concrete basement slab sustaining severe elbow, wrist and shoulder injuries; his subsequent medical treatment later led to serious infections.

Obtained a $868,000 recovery in this action brought in Federal Court under 18 U.S.C. §1983 on behalf of an undercover NYC detective who was engaged in a buy-and-bust operation. He was severely beaten by the police when he was mistakenly identified as a bank robber by fellow police officers.

$750,000 settlement for injured firefighter who fell off a ladder

Obtained a $750,000 settlement for a 39-year-old firefighter who fell 13 feet from an unsecured, portable ladder in Staten Island. The client sustained a serious fracture to his leg. This case dealt with the intricacies of NYS General Municipal Law § 205-a, also known as the Firefighter’s Rule.

$650,000 settlement for injured carpenter

Obtained a $650,000 settlement for a 46-year-old Bronx carpenter who was performing extensive renovations on a 3-family rental home. The client tripped in a passageway at the worksite, causing serious back injuries. Defendant sought to dismiss the action which the trial court denied; the trial court’s decision was unanimously affirmed after arguing the case before the Appellate Division, First Department. The case settled shortly thereafter.

Obtained a $400,000 settlement for a 49-year-old airline employee whose foot was run over by a van on Park Avenue in Manhattan, resulting in a soft-tissue injury. The van was making a left turn while the client was in the crosswalk, crossing with the light.

Obtained a $300,000 settlement for 38-year-old school aide residing in Queens. She tripped and fell on an uneven pathway of the garden apartment complex where she resided. As a result, the client sustained a fractured hip.
